License agreements and other contracts

A license agreement grants the right to use the subject of a patent, utility model, industrial design or trademark. Another form of license is the granting of unprotected but secret manufacturing or other information, i.e. know-how. Apart from traditional types of license agreements, there is a special form of mixed license – franchising.

Through a license agreement, the right of use can only be leased; it cannot be sold in this manner.


For a license agreement to come into effect vis-à-vis third parties, it must be entered into the register administered by the IPO. The license to a trademark is entered into the trademark register, the licence to an invention into the patent register, the license to a utility model into the utility-model register, and the license to an industrial design into the industrial-design register.
