Appellation of origin and geographical indication

Appellation of origin

Appellation of origin is the name of a region, particular place or country that is used to designate the merchandise coming from such area provided that the quality or characteristics of the merchandise are exclusively or predominately determined by the specific geographical environment with its characteristic natural and human factors and if the manufacture, processing and preparation of these products takes place in the given district. The traditional geographical or non-geographical designations for the merchandise coming from the specified area are also regarded as appellations of origin provided that the products meet the other requirements of this enactment.

Geographical indication

Geographical indication is the name of a territory that is used to designate the merchandise coming from such area provided that the merchandise has a particular quality, reputation or other characteristics that can be ascribed to its geographical origin and provided its manufacture, processing or preparation take place in the specified area.

A registered appellation of origin can only be used by the registered user and it cannot become the subject of a license contract.

Validity period

Protection is granted with indeterminate duration and it begins on the day it is entered into the register.

Necessary documents

  • Application form
  • Geographical definition of the territory wherein the manufacture, processing and preparation of the merchandise take place
  • A description of the characteristics or qualitative indications of the merchandise given by the specific geographical area
  • An excerpt from the record kept by the state administrative body of the territory wherein the manufacture, processing and preparation of the merchandise take place if this excerpt confirms that the applicant’s commercial premises are located in such territory or that the applicant manufactures or processes the merchandise

Registration process

The registration process is commenced by submitting the application form and all the other required documents to the Industrial Property Office. The IPO examines the formal accuracy of the application and whether or not it is eligible for registration. After it is published in the register, the desired appellation of origin and geographical indication are deemed effective.

Protection abroad

The appellation of origin and geographical indication can be protected only by means of the "national form of protection", i.e. through appealing to the respective offices of the countries wherein the owner wants to have its designations protected.
